Terms of Service

These terms govern your use of the Diver Life platform ("the Platform", "we", "us", "our"). By creating an account or using the Platform, you agree to these terms in full. If you do not agree, do not use the Platform.

1. Eligibility

You must be at least 16 years old to create an account and use this Platform. By registering, you confirm that you are 16 years of age or older. We collect your date of birth at registration to verify this. We do not knowingly permit anyone under 16 to use the Platform. If we discover that a user is under 16, their account will be terminated immediately and all personal data deleted.

2. Account Registration

When you create an account, you must provide accurate and complete information including your name, email address, date of birth, and chosen account type. You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account. You must not share your account with others or create multiple accounts.

3. Account Types & Subscriptions

Three account types are available: Recreational (free), Pro (paid subscription), and Operator (paid subscription). The Recreational tier is free and provides full access to community features. Pro and Operator tiers require a paid subscription and provide additional professional and business features as described on the Platform. Subscription pricing, billing, and cancellation terms will be published separately when paid tiers become available. All payments are processed through Stripe — we do not store payment card details.

4. User Content

You retain ownership of all content you create and post on the Platform, including but not limited to: dive logs, photos, species sightings, gear reviews, dive site contributions, posts, comments, and profile information ("User Content").

By posting User Content, you grant us a worldwide, non-exclusive, royalty-free licence to display, distribute, and make available your User Content within the Platform for the purpose of operating and improving the service. This licence continues for community-contributed data (species records, dive site data, gear entries) even after account deletion, but in anonymised form only — see Section 10 (Account Deletion).

You are responsible for ensuring that your User Content does not infringe any third-party rights (copyright, trademark, privacy), does not contain illegal material, and does not violate these terms.

5. Acceptable Use

You agree not to:

  • Use the Platform for any illegal purpose or in violation of any applicable laws
  • Harass, abuse, threaten, or intimidate other users
  • Post spam, unsolicited advertising, or misleading content
  • Impersonate another person or misrepresent your identity, qualifications, or affiliations
  • Attempt to gain unauthorised access to other accounts, systems, or data
  • Upload malware, viruses, or other harmful code
  • Scrape, crawl, or automatically collect data from the Platform without permission
  • Use the Platform to promote dangerous diving practices or encourage others to dive beyond their training
  • Post content that is sexually explicit, excessively violent, or inappropriate for a community diving platform

Violation of these rules may result in content removal, temporary suspension, or permanent account ban at our sole discretion.

6. Dive Safety Disclaimer

THE PLATFORM PROVIDES INFORMATION FOR REFERENCE AND COMMUNITY PURPOSES ONLY. IT IS NOT A SUBSTITUTE FOR PROFESSIONAL DIVE TRAINING, CERTIFIED INSTRUCTION, OR PERSONAL JUDGEMENT.

Dive site information, depth data, conditions reports, marine life data, gear recommendations, dive plans, and any other content on the Platform — whether contributed by users, generated by the system, or sourced from third parties — should never be relied upon as the sole basis for dive planning or safety decisions.

We are not responsible for any injuries, accidents, equipment failures, or deaths that occur during or as a result of diving activities, regardless of whether the diver used information from this Platform. Diving is an inherently dangerous activity. Always dive within your training limits, obtain proper certifications, use well-maintained equipment, dive with a buddy, and follow the safety standards of your certifying agency.

Species identification information on the Platform is for educational purposes. If you encounter a potentially dangerous marine animal, do not rely solely on Platform data to assess the risk. Consult local dive professionals and marine authorities.

7. Gear & Equipment

Gear information, reviews, and recommendations on the Platform are user-contributed and do not constitute professional advice. We do not endorse, certify, or warranty any equipment listed in the gear database. Service interval reminders are estimates only — always follow manufacturer guidelines for equipment maintenance and servicing. We accept no liability for equipment failures or malfunctions.

8. Community Data Contributions

The Platform operates community-contributed databases for marine species, dive sites, and diving gear. When you contribute to these databases (adding species, dive sites, gear items, relationships, or sighting data), your contributions become part of the Platform's shared knowledge base. This data may persist in anonymised form after account deletion to preserve the integrity of the community databases — see Section 10.

9. Moderation & Content Removal

We reserve the right to review, edit, or remove any User Content that violates these terms or that we deem inappropriate, inaccurate, or harmful. Community managers may merge duplicate entries, correct factual errors in database contributions, and moderate flagged content. Users can report content for review. We aim to respond to reports within a reasonable timeframe.

10. Account Deletion & Data Anonymisation

You may delete your account at any time through the Platform settings. Upon requesting deletion, your account enters a 30-day grace period during which you can cancel the deletion and restore your account. After 30 days, the following occurs:

  • Deleted permanently: Your personal information (name, email, date of birth, profile photo, bio, location, settings, preferences, messages, buddy connections)
  • Anonymised and retained: Your community contributions (dive logs, species sightings, dive site additions, gear entries, marine life relationships, posts, comments, ratings, scores) are retained but attributed to an anonymous user ("Captain Nemo") so they can no longer be traced back to you

This approach preserves the integrity of community databases and ecological data while ensuring your personal information is permanently removed. Anonymised data cannot be restored to your identity.

11. Intellectual Property

The Platform's design, branding, code, and original content are our intellectual property. You may not copy, modify, distribute, or reverse-engineer any part of the Platform without our written permission. User Content remains the property of the respective users as described in Section 4.

12. Third-Party Services

The Platform integrates with third-party services including Mapbox (maps), Stripe (payments), Google (authentication), and others. Your use of these services is subject to their respective terms and privacy policies. We are not responsible for the availability, accuracy, or conduct of third-party services.

13. Limitation of Liability

To the maximum extent permitted by law, the Platform and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of profits, personal injury, or death, arising from your use of or inability to use the Platform. This includes, without limitation, any reliance on dive site data, species information, gear recommendations, or conditions reports available on the Platform.

14. Changes to These Terms

We may update these terms from time to time. Material changes will be communicated via the Platform (notification or email). Continued use of the Platform after changes constitutes acceptance of the updated terms. If you disagree with any changes, you should stop using the Platform and delete your account.

15. Governing Law

These terms are governed by and construed in accordance with the laws of the jurisdiction in which the Platform operator is registered. Any disputes arising from these terms or your use of the Platform shall be subject to the exclusive jurisdiction of the courts in that jurisdiction.
